이 이야기는 실제 있었던 일이고, 현재 진행 중입니다.

사업을 하다 사정이 어려워져서 2년 정도를 쉬면서 건설현장에 노가다를 전전하다가 큰 애가 초등학교에 입학하고 둘째도 유치원에 다니고, 월드컵도 곧 시작할 것인데 즐거운 마음으로 축제를 즐기려면 ....... 안정된 수입이 필요하여 보험영업을 하기로 마음먹고 보험사에 취직하여 보름 가까이 교육을 받고 있을 때였다. 어버이날을 하루 앞 둔 작년 2002년 5월 7일 아침 출근시간부터 있었던 일이다.

미리서 말씀드리면 -여기에 나오는 이야기 때문에- 보험 일은 못하게 되었고.......
아이러니하게도 몇 개월 지나서 작년 추석에 할머니 집에 인사드리러 갔더니, 삼촌이 교통사고가 두 달 반전에 났다면서 척수장애로 누워 있었는데 보험사에서 치료도 안 해주고 있었고 보험금도 받지 못할 형편이 되어 있었다.

보험사하고 몇 군데 대학병원의 교수-의사들하고 척추신경전문병원하고 손해보험협회에서 짜고서 환자의 생명과 건강을 가지고 돈 때문에 의료부정을 저지르고 있었던 것이었다.

6개월을 혼자서 -보험법, 도로교통법, 교통사고특례법, 자동차손해보장법, 손해사정인, 의료법, 해부학, 비뇨기학, 신경학을 공부해서 ....... 보험사하고 의과대학교 교수들- 전문의들 해서 의사들 9명하고 싸워서 ....... 보험사에서 300만원에 합의보자고 변호사를 선임해서 올해 2월 6일에 부산지방법원을 통해서 소송을 걸어오는 것을 4천만 원을 받아냈고, 마침 삼촌이 다른 보험사에도 운전자보험이 들어 있어서 300만원 준다고 하는 것을 또 싸워서 8천만 원을 받아냈다. 결론적으로, 내 입장에서 보면 보험일 하겠다고 보험을 배운 것이 보험일은 못하고 집안일에 잘 써먹게 되었다.

다시 이야기를 본론으로 들어가면 -

보험사에 입사하여 교육을 받고 있던 5월 6일 교육을 마치고, 회사에서 “금융감독원 시험에 사진이 한 장 필요하니 내일-5월7일-아침 9시까지 사진을 한 장 가져오라”고 했다. 만약에 시간 내에 사진을 제출하지 못하면 다음 달 시험에 응시해야 한다는 것이었다. 결론적으로 그 달에 시험을 치루지 못하면 보험설계사 자격시험은 월말에 있으니 한 달 반을 놀아야한다는 계산이었다.

5월 7일, 사진을 찍어야 한다는 생각에 아침에 일어나 샴푸로 머리를 감고 평소보다 30분 정도 빠른 8시경에 집에서 나섰다. 밖에 부슬비가 왔으므로 한 손에 기다란 우산을 들고 나갔다. 한 손에는 노트북 가방을 들고 있었다. 15인치 화면의 매킨토시-노트북을 담아 다니려고 몇 칠전에 구입한 가방이었다.

집에서 150미터 정도에 버스정류소가 있고, 버스 정류소 바로 앞에 사진관이 있다. 사진관에 가서 문을 열려고 하니 문이 잠겨 있어서 초인종이 있어서 누르니 주인이 나오지 않았다. 가정집하고 붙어 있는 사진관이라 아침 시간에 불 켜 놨으면 주인이 있을 것이라 생각하고 기다리기로 마음먹고 초인종을 몇 번 더 눌렀다.

그랬더니 사진관 주인 대신에 사진관하고 붙어 있는 옆집 떡 방앗간에서 방앗간 아주머니가 나오셨다.

“주인 식사하고 있는 것 같은데 곧 나올 것이니까 가지 마시고 기다리세요.”
‘예, 걱정마세요. 여기서 사진 찍고 갈거에요. 역시 동네 인심이 좋긴 좋군요.’

곧이어서, 옆에서 50대 정도로 보이는 아주머니가 2-3세로 보이는 아기를 안고 올라오셨다.

“손님 기다리게 해서 죄송합니다.”
‘괜찮습니다. 제가 너무 일찍 왔나 봅니다.’

사진관 주인이 열쇠로 문을 열고 같이 안으로 들어갔다. 사진관 안이 6-7평 정도 되고, 가로 세로 폭이 4미터 6미터 정도 되는 직사각형 모양의 실내였다.

주인이 먼저 내모난 등받이 없는 의자를 꺼내서 내가 앉을 자리에다가 갖다 놓고 반대편 벽에서 바퀴달린 카메라를 밀고 나와서 사진 찍을 준비를 하였다. 손님이 앉는 의자는 방문 앞에 자리를 잡도록 되어 있었고 카메라 위치는 방문과 반대편 이었다. 노트북 가방과 우산을 사진 찍는 의자 옆 오른 쪽에 같이 놨다.

의자에 앉았다가 그래도 거울을 한번 봐야겠다는 생각이 들어서 거울 앞에 가서 빚을 찾았더니 주인이 빚을 챙겨줘서 집에서 빗고 나온 머리를 한 번 더 빗었다. 머리를 빗으면서 -

‘아주머님이 직접 찍으세요?’
“저희 아저씨가 잠깐 멀리 가 계셔서 안 계실 동안만 제가 찍어드려요. 사진 잘 찍어드릴 테니까 걱정하지 마세요. 저희 집에 처음이세요?”
‘예, 처음입니다. 아니, 처음이 아니네요. 전에 아저씨 계실 때 필름 현상하고 인화를 맡긴 적이 몇 번 있네요.’

머리를 빗고 나는 의자에 앉고 주인은 카메라 앞에 섰다.

“셔터 누르실 때 ‘하나-둘-셋’ 하지 마시고 그냥 ‘둘-셋’하세요. 하나-둘-셋 하면 호흡이 길어져서 표정이 굳어지거든요.”
“알았어요. 자-아- 고개 약간만 숙이고, 찍습니다. 하나- 둘-.......”

내가 웃으면서 손을 약간 가볍게 내저으며

‘하나-둘-셋 하지 마시고 둘-셋 하시라니까요.’

주인과 내가 가볍게 웃었다. 다시 폼을 잡자 - “찍어요, 둘-셋”하고 셔터를 눌렀다. 주인하고 나하고 다시 한번 웃었다.

주인이 곧바로 카메라에서 인화지를 뽑아서 드라이로 말렸다.

‘저도 사업하다가 어려워져서 10여일 전쯤에 회사에 취직했는데, 어저께 회사에서 오늘 아침 9시까지 사진 한 장 가져오라 해서요. 저도 남의 사진만 찍어주다가 제 사진 찍으니까 분위기가 어색하네요.’

“무슨 일 하셨는데요?”
‘광고 출판 쪽에 일했습니다.’
“집이 근처이신가 보지요?”
‘예, 여기 사진관하고 파출소 중간 떡 방앗간 바로 옆집입니다.’
“자주 오세요. 잘 해 드릴게요.”
‘예-’

드라이로 30-40초 정도 인화지를 펴가면서 말린 주인이 넉 장 중에서 한 장을 가위로 건네주면서 -

“사진 잘 나왔네요. 한 번 보세요.”
‘예, 잘 나왔습니다. 표정이 편하게 나왔네요.’

주인이 능숙한 가위질 솜씨로 나머지 사진 석장을 마저 재단하였고, 나는 샘플로 보여준 사진을 주인에게 건넸고, 주인은 그것을 받아서 나머지 석장과 함께 카운터 안 쪽으로 가서 봉투에 담았다. 나도 카운터 앞에 섰다.

지갑을 벌리면서 ‘얼마지요?’하고 물었다.

“6천원입니다.”

순간 돈을 꺼내려다 말고 멈췄다. 나는 그 때 4천원을 가지고 있었다. 증명사진값이 4천원이 안 넘어 갈 줄로 알고 4천원만 있는 상태에서 사진을 찍으러 들어온 것이었다.

“왜 그러세요?”
‘어떡하지요? 4천원 밖에 안 가지고 있는데, 나머지는 퇴근 후에 갖다드리면 안 될까요?’
“그럼, 그러세요. 집이 근처라고 하셨지요?”
‘예’

지갑에서 4천원을 꺼내서 사진관 아주머니한테 드렸고, 사진관 주인은 나한테 사진봉투를 건네 주셨다.

“연락처 하나 적어주고 가세요.”

‘그러지요.’하고 대답하고서 사진을 주머니에 넣으려다 말고 사진을 계산대 위에 놓고 양복 주머니에서 볼펜을 찾았다. 양손으로 양복 주머니에서 볼펜을 찾으면서 무심결에 -

‘사진값이 생각보다 비싸군요. 저는 증명사진은 안 찍어봐서 잘은 모르지만 비싸다는 생각이 듭니다.’

이것이 화근이었고, 이것이 실수였다.

“비싼 것이 아니어요. 다른 사진관도 다 마찬가지에요.”
‘아주머니 집이 딴 데보다 비싸다고 말씀드리는 것이 아니고 증명사진 값이 생각보다 비싸다고 말씀드린 것이에요.’

별 생각 없이 또 대답을 하였다. 주머니에서 볼펜을 찾아서 카운터에서 메모지를 찾으니 안 보여서, 사진 봉투 중에서 제일 위에 있는 구겨진 것 하나를 잡고 ‘여기다 휴대폰 번호 적어 드릴게요.’하면서 사진관 주인 얼굴을 쳐다보니 ....... 째려보고 있었다.

“휴대폰 적을 필요 없고 주민등록증 좀 봅시다.”
‘.......?’

순간적으로 사진관 주인이 사진값 비싸다는 말에 마음이 상해 있다는 것을 알았다. 아차 싶었지만 표시를 안 내려고 했다. 휴대폰 번호를 적으려다 말고 ‘그러지요.’하고 지갑을 펼쳐서 주민등록증을 보여줬다.

그랬더니 주인이 “주민등록증 맡겨 놓고 가세요.”라고 했다.

‘....... 주민등록증은 맡겨 놓고 갈 수 없습니다. 회사에 나간 지 얼마 되지도 않았는데 회사에서 한 번씩 신분증 확인도 해서요.’

갑자기, 주인이 내가 볼펜 찾는다고 카운터 위에 올려놓은 사진봉투를 잽싸게 낚아채 갔다.

“큰 돈 있으면 내 놔요, 바꿔줄 테니까. 지갑 한 번 벌려 봐요.”

마음이 상했지만 표시를 안 내려고 했다.

‘가진 것이 드린 4천원 밖에 없어요. 카드 말고는요, 사진 주세요. 2천원은 퇴근 후에 갖다 드릴 테니까요.’ 하고 손을 내밀었다.

“집에 가서 2천원 더 가져와요. 그라믄 사진 줄 테니까. 양복 입고 넥타이 메고 아침에 출근하는 사람이 돈 6천원도 안 가지고 있어요? 일진이 안 좋을라니까 맞수부터 재수 없게, 사진 찾아 갈라믄 집에 가서 돈 가져와요.”

순식간에 상황이 이상하게 꼬인 것을 알았다. 사무적으로 말했다.

‘사진은 주세요. 저 회사 가야 됩니다. 나머지 2천원은 퇴근 후에 갖다 드릴게요.’
“사진 못 줘요. 돈 가꼬 와요.”

어이가 없었다. 주인의 눈을 쳐다봤다. 주인도 같이 마주 봤다. 몇 초 정도 말없이.

갑자기 주인이 돈 4천원과 사진봉투를 쥔 채로 옆으로 훽 돌아서더니 조금 전에 내가 사진 찍었던 의자 옆 방문 앞으로 가서 소형금고를 열고서 돈과 사진 봉투를 한꺼번에 처박아 버리는 것이었다. 순간 어찌나 당황했는지....... 시험 본다고 원서에 붙일 사진인데.......

주인이 사진과 봉투를 금고에다 처박고는 곧바로 나를 째려보면서 독한 말투로 -

“원 참, 아침부터 재수가 없을라니 뭐? 사진을 몇 년간을 찍어? 넥타이 메고 출근하는 인간이 돈 6천원도 없으면서 사진값이 비싸네 마네 그래? 집에 가서 2천원 더 가꼬와.”

그 순간, 내 입에서 ‘아, 씹할’이라고 욕이 튀어나오고 말았다.

아차! 싶었지만 주어 담을 수가 없었다. 자존심이 상하고 순간적으로 배신감이 일어났던 것을 그 순간을 참지 못했던 것이었다. 다음 순간 아주머니가 나한테 달려들었다.

“뭐? 씹할 - 아나 이 놈아, 니기 애미한테 가서 씹할년 해라, 이 개 같은 놈아 .......” 노발대발을 하면서 쫓아와서 멱살을 잡으려고 했다. 손으로 막았다. 그러자 주먹을 쥐어서 손바닥으로 쳤다. 막무가내로 내 가슴을 쳐댔다. 맞아줬다. 내 입에서 나온 말이 잘못된 것인 줄 알고 전혀 대응을 하지 않았다. 같이 대응을 했다간 큰 일 날 것이란 예감이 들었다. 주인이 화가 날대로 나서 주먹을 쥔 채로 연속해서 마구 가슴을 때렸다. 뒤로 약간 씩 밀리면서 ....... 피하기도 하면서 맞는 충격을 줄였다. 인정사정없는 욕설과 함께 손바닥 주먹으로 10대 정도를 쥐어박고는 주인이 어느 정도 화가 풀렸는지 행동을 멈췄다.

순식간에 황당한 일이 벌어진 것이었다. 기분이 좋을 리 없었다. 그래도 사진을 회사에 가지고 가야 했다. 그 사진관 말고는 그 근처에 다른 사진관이 없다. 시내 사진관은 10시나 되야 문을 열 것이고.

‘욕한 것은 죄송합니다. 회사에 사진 꼭 가지고 가야 하니까 사진은 주세요.’ 사무적으로 말했다.

“사진 못 줘, 이 개 같은 놈아. 니기 애미한테 가서 씹할년 해라, 이 개같은 놈아 호로새끼 같으니라고.” 주인의 욕설이 끝도 없고 거침이 없었다. 나도 언성을 높여서 사무적으로 말했다.

그러자 사진관 주인이 사진관 출입문을 열고 큰 소리로 다급하게 누구를 몇 차례 불렀다. 곧이어 옆에서 누군가가 나와서 사진관 안을 들여다보았다. 아까 그 방앗간 주인이었는데 부끄럽고 수치스러웠다.

‘사진 주세요. 출근해야 합니다. 출근하는 젊은 사람 나쁜 놈 만들지 말고 빨리 사진 주세요. 잔돈은 나중에 갔다 드릴게요. 동네서 이게 뭐하는 겁니까?’

주인이 계속하여 쌍욕으로 일괄했다. 그 때 30대 초반으로 보이는 젊은 부인이 “어머니 아침부터 무슨 일이세요?”하면서 사진관 안으로 들어왔다. 사진관 주인의 딸이었다. 그러자 아주머니가 “이 놈이 나보고 씹할년이라고 했다.”고 했다. 젊은 부인이 기분 나쁜 눈초리로 나를 쳐다보았다. 그 젊은 부인과 눈을 마주쳤다가 이내 눈을 피해버렸다. 시비 가운데에서는 감정이 상할 수 있으므로 서로 간에 피하는 것이 상책이라는 것을 알기 때문이었다. 나는 상황파악이 대단히 빠른 사람이다. 그 부인도 이내 나한테서 눈을 거두고 아기를 안고 자기 어머니한테 출근해야 한다면서 인사를 하고 밖으로 나갔다. 그 때 애기 눈을 봤더니 말똥말똥하니 약간 겁은 먹고 있었지만 호기심 어린 표정으로 나를 쳐다보고 있었는데 부끄러웠다. 애기가 있었다는 것을 기억하지 못하고 있었었다.

젊은 부인이 왔다 간 이후부터는 아주머니가 더 이상의 욕설은 하지 않았지만, 대신에 반말로 일괄했다. 사진관 안에 다시 사진관 주인하고 나하고만 남았다.

‘사진 주세요. 출근해야 됩니다. 나머지는 퇴근 후에 갖다 드릴게요.’
“사진 못 줘, 어디서 배워먹은 행짜머리야, 돈 가져와.”

출근시간이 다가오는데 어이가 없었다. 어떻게 이런 사람이 다 장사를 한다고.......사진관 하는 사람이 시험 본다는 사람 증명사진을 손님 보는 앞에서 어떻게 처박을 수 있고, 손님이 설사 성질에 못 이겨서 욕이 한번 튀어나왔다 해도 그 이후로 그만큼 대응 안하고 당해줬으면 미안한 마음도 들 것인데 ....... 손님한테 그렇게 해 놓고도 미안한 감정이 없다는 것이 정상은 아닌 것 같은 생각이 들었다.

더 이상 참을 수가 없었다. 사진관 주인이 인간적으로 미워지기 시작했다. 아무리 세상물정 모르는 아주머니라 해도 상식이 없어도 너무했다. 같은 동네서 바로 코앞에 산다는데 심해도 너무 심했다.

‘아주머니, 증명사진 넉장에 6천원하면 비싼 것 아니요? 인화지 값 해봐야 몇 백원 하지도 않을 것인데?’

“사진 못 줘”
‘사진 못 주실 것 같으면, 돈 주세요. 내 돈입니다. 사진값은 나중에 갖다 드릴게요.’
“돈 가꼬와서 사진 찾아가”
‘사진을 주시던지 돈을 주시던지 하세요.’
“돈도 사진도 아무 것도 못 줘, 돈 가꼬와서 사진 찾아가”
‘돈 주세요. 그 돈 내 돈입니다. 4천원 주고 사진 받았습니다. 그런데 나중에 사진도 다시 가져가 버리고 돈도 안 주면 이치에 안 맞습니다. 사진 안 주신다고 하니 돈 주세요. 그 돈 내 돈입니다. 사진값 6천원은 나중에 와서 갖다 드릴게요. 옆에 살면서 얼굴 나와 있는 사진값 안 떼먹을 테니까 돈 주세요. 출근해야겠습니다.’

“못 줘, 집에 가서 2천원 더 가꼬와”
‘아주머니 이건 사기요. 4천원 받고 사진 주고 나머지는 나중에 받기로 해 놓고 지금 와서 둘 다 안 주는 것은 사기요.’
“그래, 이 놈아 신고할라믄 신고해봐라. 넥타이 메고 출근하는 놈이 돈 6천원도 없이 사진 찍으러 와?”

더 이상 할 말이 없었다. 솔직히 사진관에서 집까지 거리가 150미터도 채 안 되는데 가서 돈을 더 가져올까 하고 생각을 안 해본 것도 아닌데 ....... 출근한다고 벌써 나간 놈이 돈 2천원 때문에 또 다시 가서 ‘2천원만 주라.’고 하는 것도 우스운 일이었다....... 근처에 은행도 없다. 슬슬 오기가 발동했다. 참을 만큼 참았다고 판단이 드는데 사진관 주인이 심하다는 결론이 내려졌다.

사진관 주인하고 나하고 잠시 동안 말없는 소강상태가 유지되었다. 사진관 주인이 나를 세워두고 비자루 질을 하고 청소를 하였다. 한심하고 황당했다.

사진관 주인이 사진을 찍기 위하여 밀고 나온 바퀴달린 카메라를 다시 처음에 있던 자리- 벽 쪽으로 원위치 시켰다. 그리고 카메라 뒤에서 카메라를 만지작거리면서 정리정돈을 하였다. 사진관의 원래 위치는 방의 문과는 반대편 벽으로 사진관 실내에서 제일 먼 거리다. 거리가 한 5미터 정도나 될까?

나는 그 때 방문 앞에 있었다. 내 돈은 가져가고, 사진은 나중에 다시 와서 사진값을 주고 찾아가야겠다고 마음을 먹었다. 나중에 사진값을 주고 사진을 찾아서는 그 사진들은 불태워버려야겠다고 다짐했다. 그 증명사진은 더 이상 쓰고 싶지가 않았지만, 대신에 사진관에 손해는 입힐 수 없으니 사진값을 주고 찾아가는 것이 맞다고 혼자서 생각을 했다.

사진관 주인이 반대편 카메라 뒤에서 청소를 하면서 카메라를 손 보고 있었다.

‘내 돈 가지고 갑니다.’

똑똑하고 큰 소리로 사무적으로 말했다. 금고에는 내가 준 4천원과 사진봉투가 처박혀 있었고, 다른 천원 짜리 묶음과 동전이 구분되어 있었다. 말과 동시에 4천원을 오른쪽 바지 주머니에 넣고, 사진 찍을 때 의자 옆에 놓아 둔 노트북가방을 왼손에 들고, 오른손에는 우산을 집어 들고 출입문 쪽으로 향했다.

주인이 쫓아왔다. 내가 문 앞에 도착하기 전에 주인이 내 노트북가방을 두 손으로 통째로 뺐을려고 하다가 미끌리면서 노트북 어깨끈을 잡았다. 나는 노트북가방 손잡이를 잡고 있는 상태였다.

“이 도둑놈아 돈 내놔, 돈 내놓고 가”
‘이 돈은 내 돈이요. 내 돈 내가 가지고 가요. 사진값은 나중에 가지고 올게요. 가방 놓으세요.’
“이 도둑놈아 못 가, 돈 내놓고 가 이 도둑놈아”

‘가방 놓으세요. 출근해야 합니다. 사진값 6천원은 나중에 다시 와서 드릴 테니까 이것 놓으세요. 동네서 출근하는 놈 잡아놓고 이게 뭐하는 짓입니까? 옆에 살면서 내 얼굴 사진 나와 있는 그깟 6천원 안 띠어먹을 테니까 이것 놓으세요.’

사진관 주인은 욕설과 함께 두 손으로 노트북가방을 흔들어 댔고, 나는 오른손에는 우산을 가지고 있어서 왼손으로만 노트북가방 손잡이를 잡고 있었는데 ....... 노트북가방이 내 물건이었으므로 나는 조심하는 입장이었다. 주인은 악착같이 매달려서 두 손으로 가방을 뺏으려고 했다.

사진관 출입문 못 미쳐서 사진관 주인하고 나하고 가방을 두고 한참 동안을 실랑이를 하고 있었다. 주인은 막무가내로 뺏으려고 하고 나는 조심하면서 뺏기지 않으려고 하고....... 한참을 두 사람이 잡고 있었다.

그러다가 사진관 주인이 가방을 기어코 뺏으려고 힘을 막무가내로 쓸 때 사진관 주인이 잡아당기던 노트북가방 어깨끈이 떨어졌다. 그러면서 주인이 주춤거리면서 다리가 엇갈리면서 엉덩방아를 찧었다. 나도 몸이 앞으로 쏠리면서 출입문으로 나왔다. 밖으로 튀어나왔더니 2차선 길 건너편에서 버스를 기다리는 사람들이 10명이 넘게 이쪽을 쳐다보고 있었다. 순간적으로 수치스럽고 당황했다. 사진관 출입문에서 서너발짝 나왔다가 다시 돌아섰다. 사진관 주인이 쥐고 있는 떨어진 가방끈을 돌려받야겠다는 생각이 들어서였다. 사진관 주인이 벌떡 일어나서 막 쫓아 나오고 있었다. 주인이 사력을 다해서 고함을 쳤다.

“도둑놈 잡아라. 이 도둑놈아 돈 내놔, 남의 금고에서 돈을 훔쳐가? 이 도둑놈아-”

주위를 둘러보니 길 건너편에도 버스 기다리는 사람들이 10명 넘게 있었고, 이 쪽에도 10명 정도가 버스를 기다리고 있었다. 옆에 가게들에서 사람들이 나왔다. 여기서 몰리면 오해받을 수 있다는 생각에 재빨리 대응했다.

‘못 줍니다. 4천원은 내 돈입니다. 가방끈 주세요. 어서요’
“돈 내놔, 이 놈아, 나쁜 놈아, 어디서 사람을 밀치고 금고에서 돈을 훔쳐가- 이 놈아, 나쁜 놈아, 도둑놈의 새끼 같으니라고.”

사진관 주인이 말을 비틀어서 했다. 옆에 사람들 들으라고 “금고에서 돈 훔쳐간 도둑놈”이라고 쌍욕과 함께 악을 쓰면서, 분을 이기지 못했다.

사진관 주인이 분을 이기지 못하고 쥐고 있던 노트북가방 어깨끈으로 사정없이 후려 갈기기 시작했다. 노트북가방 어깨끈에는 양 쪽에 묵직한 쇠고리가 3개씩 하여 6개가 달려 있었는데 맞으니 아팠다. 쌍욕과 함께 연거푸 서너대를 후려 갈겼다. 양 옆에서 20명도 넘게 여기를 바라보고 있는데 양복 입고 피하는 도망치는 모션을 취하기 싫었다. 가방으로 막긴 했는데 휘두르는 데로 맞았다. 끝에 무거운 추가 달려 있어서 채찍처럼 휘감기면서 여지없이 살을 파고드는 것이었다.

부아가 치밀었지만 그 많은 우리 동네 사람들 앞에서 참을 수밖에 없었다. 또 “돈 내놔, 이 도둑놈아” 하면서 또 가방끈을 휘둘렀다. 또 맞았다.

‘동네 사람들 앞에서 나쁜 놈 만들지 말고 가방끈 주세요. 어서요.’

사진관 주인이 또 가방끈을 휘둘렀다. 연거푸 또 맞았다. 또 휘두르기에 가방으로 막았는데 이번에는 그만 가방끈 쇠고리에 왼손등 검지손가락 마디에 정통으로 맞았다. 무척 아파서 순간적으로 가방과 우산을 놓고 오른손으로 왼손등을 감쌌다.

그 순간 사진관 주인이 달려들어서 내 혁대를 잡더니 한 손으로 오른쪽 바지 주머니에 손을 쑥 집어넣었다. 얇은 여름 양복바지 국부 근처로 나이 든 여자 손이 불쑥 들어오니 기분이 더러웠다. 오른 손을 집어넣어 사진관 여자 손을 잡았다. 사진관 주인이 돈 4천원을 거머쥐고 있었다.

‘돈 놓고 손 빼세요.’
“내 돈이다. 이 놈아, 이 개 같은 놈아.......”

사진관 주인이 욕설과 함께 끝까지 돈을 뺏어갈려고 했다. 옆에 수십 명 동네 사람이 보고 있는데 그런 망신이 없었다. 와이샤스가 삐져나오고, 혁대 고리가 떨어지고, 양복 바지주머니 실밥이 터지기 시작했다. 사진관 주인이 돈을 빼가도록 손에 힘을 빼고 휴대폰을 꺼내 들었다. 여자가 돈을 빼갔다. 내 휴대폰으로 112에 신고를 해서 사진관 앞으로 경찰을 보내주라고 했다. 집 앞에서 동네 사람들 수십 명 보는 앞에서 “금고에서 돈 훔쳐간 도둑놈”이라고 고함을 질러서 정식으로 해명을 하는 것이 필요하다고 판단했기 때문이다.

여자가 돈을 빼가고도 혁대를 놓지 않고 잡고 있었다.

‘경찰 곧 올 테니까 놓으세요.’

그래도 안 놓고 있다가 옆에 구경꾼들이 놓으라고 해서 그 때서야 놨다. 잠시 후에 경찰이 왔다....... 이후로 나오는 모든 경찰과 검사 이름은 실명이다. 50대 정도의 경찰관 신상윤과 30대 정도의 경찰관 이두희였다. 신상윤이 차에서 내려 다가오면서 “무슨 일입니까?” 했다.
그런데 ....... 그 때 젊은 경찰관 이두희가 옆에 나와 있던 아까 애기 안고 나간 사진관 주인 딸을 보고 물었다.

“아니, 정선생이 여기 어쩐 일이십니까?”

정선생이라는 사진관 딸하고 출동 나온 경찰관들 두 명이 알고 있는 사이였다.

“이 놈이 사진 찍고, 금고에서 돈을 훔쳐가려고 하는 것을 잡아 놨다. 이 놈이 돈을 훔쳐갈 때 나를 사정없이 벽에다가 처박았다.”

“이 분이 아침에 사진을 찍고 사진값이 부족해서 시비가 있었는데 나중에는 금고에 있는 돈을 훔쳐서 달아나다가 저희 어머님을 밀어서 처박았고, 그리고 도망 나오다가 저희 어머니한테 붙잡히신 것입니다.” 사진관 딸이 한 말이었다.

‘아주머님이 보셨어요? 안 보셨잖아요? 그 때 거기 안 계셨잖아요? 처음에 올라오셨다가 바로 애기 안고 인사하고 나가셨잖아요? 본 것처럼 말씀하지 마세요.’

경찰관 신상윤이 사진관 주인 딸한테 거기에 같이 있었냐고 물으니 “그 자리에는 없었고, 어머님이 그렇게 말씀 하셨다.”고 했다.

‘경찰에는 제가 신고했습니다. 112에 확인해 보면 제 휴대폰 번호가 나올 것입니다. 아침부터 황당한 일을 당해서 더 이상 확대 안 시키려고 제가 신고한 것입니다. 아주머니 말 비틀어서 하지 마시고 사실 데로 말씀하세요.’

그러자 사진관 주인이 노트북 가방끈으로 경찰이 있는데도 또 때리려고 했다.

“남의 금고에서 돈을 훔쳐가? 니기 애미한테 가서 씹할년 해라, 이 놈아 -”
‘그 돈은 내 돈이요. 손님한테 하는 짓이 뭡니까? 때리지 마세요. 아파요.’

사진관 주인이 가방끈으로 또 때리려고 했다.

‘가방끈 주세요. 내 것입니다.’
“못 줘, 이 놈아” ‘주세요. 때리지 마세요.’

또 때릴려고 했다. 경찰을 보고 말했다.

‘저 가방끈 넘겨주라고 하십시오. 제 가방에서 떨어진 것입니다. 때리지 말라고 하십시오. 저 동네 사람들 보는 앞에서 저 쇠고리 달린 가방끈으로 열대나 맞았습니다.’

나이 든 경찰관 신상윤이 “그 가방끈이 이 사람 것이 맞냐?”고 물어봤고, “이 사람 것이면 이 사람한테 주라.”고 해서 여자가 멈칫거리다가 가방끈을 나에게 넘겨주었다.

경찰관들한테 자초지종을 말하였다. 경찰관 신상윤이 말했다.

“동네 사람들 보고 있으니까 안에 들어가서 이야기 합시다.”

사진관 안에 들어가서 여자는 ‘내가 사진을 찍고 준 돈을 금고에서 훔쳐갔고, 잡으려고 하니까 사정없이 벽에다 처박아 버렸다.’고 거짓말로 우겼다. 나는 사정이 그렇지 않다고 말했다.

여자가 없는 것까지 지어내서 거짓말을 하였고, 끝까지 우기려는 심사가 보였다. 옆에서 딸도 어머니 주장을 자기가 본 것처럼 반복해서 말하는데....... 경찰관 두 명하고 상당히 잘 알고 지내는 친분이라는 것을 알았다. (나중에 알고보니 사진관 주인 딸은 파출소 옆 건물 동사무소 반 지하에 있는 유치원 선생이었다.) 사진관 옆집에서- 옆집에서 사람들이 몰려 나왔다. 거기에 있어봐야 결론도 나지 않고 출근 시간만 지체될 뿐이고, 주위 분위기가 내가 몰릴 것 같은 생각이 들었다. 내가 말했다. ‘파출소로 갑시다.’

[파출소 안]

파출소로 가는 차 안에서 경찰관 신상윤이 “별 것도 아니니 두 분이 화해를 하시고 없었던 일로 마무리를 하십시오.”하고 화해를 권유했다. 나는 그러겠다고 했다. 사진관 주인은 파출소에 간다고 하니 겁먹은 표정이 보였다. 8시 35분쯤에 부산 동구 범일동에 있는 범곡파출소에 도착했다. 우리 집에서 100미터 정도 밖에 안 떨어진 거리이다.

파출소에 도착하니 경찰관들이 15명 정도가 있었다. 의경들도 여러 명 있었고. 아침 조회를 위해서 외근 중이던 사람들이 많이 들어와 있었고, 야간 조와 주간 조가 임무 교대를 한다는 것을 알 수 있었다. (다시 한 번 말하지만 여기에 나오는 모든 경찰과 검사는 실명이다.)
무슨 일이냐고 파출소장-김영상 경위가 물었다.

“별 것 아닙니다. 사진값 몇 천원 때문에 사소한 시비가 있었던 것 같습니다. 두 분 다 적당히 하고 화해하고 나가세요. 아저씨는 출근해야 할 것 아닙니까?” 경찰관 신상윤이 말했다.

“말씀들 해보세요.” 파출소장이 말했다.

내가 자초지종 사정 이야기를 하였다. 사진관 주인도 말했다.

“처음부터 돈이 4천원밖에 없으면 ‘나중에 갔다 드릴게요’ 했으면 사진을 좋게 줬을 것인데 처음부터 테이블을 탕탕 치면서 사진을 내 놓으라고 하잖아요. 그리고는 나를 벽에다가 인정사정도 없이 처박아 버리고 금고에서 돈을 훔쳐가길래 어찌나 분하던지 막 달려나가서 ‘도둑놈 잡아라’고 소리를 치면서 때려 잡았습니다. 나중에는 혁대를 잡고 도망 못가게 해서 도망가는 놈을 잡아놨습니다. 금고에서 돈 훔쳐간 도둑놈을 가만 놔 둘 수 있는가요?

사진관 주인이 없는 말을 꾸며서 거짓말을 했다.

나 : 아주머님이 말씀을 비틀어서 사실과 다르게 말씀하십니다. 저는 아주머니를 밀거나 벽에 처박은 적이 없습니다. 가방끈 떨어지면서 아주머니가 주춤거리다가 엉덩방아 찧은 것 말고는 없습니다.

사진관 주인 : 젊은 사람이 거짓말을 하면 못 써요. 아저씨가 돈 훔쳐갈라고 나를 벽에다가 인정사정없이 처박아 버렸잖아요?

그 때 파출소 안으로 아까 그 사진관 딸이 들어왔다. 파출소 안에 있는 모든 경찰관들이 그 여자한테 인사를 했다. (그 여자가 파출소 옆 동사무소에 있는 유치원선생이라는 것은 잠시 후에 알았다.)

“이 분이 정선생님 어머님이십니까?” “아침부터 어떻게 된 것입니까?.......

순간 낌새가 이상하다는 것을 알았다. 그 젊은 여선생과 경찰관들이 다 알고 지내는 사이였는데, 현장에 출동 나온 경찰관 두 명이 그 젊은 여자한테 인사를 할 때부터 이상하게 생각이 되었는데, 여기 파출소에 오니 거의 모든 경찰관들이 인사를 하는 것이었다.

내가 정선생이란 사진관 딸을 얼굴을 한 번 쳐다보고 인사하는 경찰관들을 쭉 훓어보면서 경찰관 한사람 한사람씩 짧게나마 눈들을 쳐다봤다. 경찰관들이 더 이상 그 정선생하고 인사를 나누지 못했다.

주위를 살펴보니 CC-Tv 두 대가 돌아가고 있었다. 파출소 출입문에서 봤을 때 왼쪽 벽 중앙에 회색 Tv가 이제 막 가져온 듯한 새것으로 화면이 깨끗하게 돌아가고 있었고, 정면 중앙 벽 우측 상단에는 검은색 네모반듯한 구형 Tv가 검은색 비디오 기계 위에 얹혀진 채로 화면이 돌아가고 있었다. 낡았지만 화면 상태는 깨끗했다. 카메라 두 대가 거의 사각 없이 앵글을 잡아서 비디오로 녹화되고 있었다. (참고로, 경찰 내규에 파출소는 CC-Tv로 24시간 화면을 녹화하고 소리를 녹음하도록 의무화 되어 있고, 그 기록을 보존하여야 한다고 되어 있다.)

사진관 딸 : 저희 어머님이 말씀을 조리 있게 못하시니까 대신 제가 말씀드릴게요. 이분이 아침에 사진을 찍고 사진값이 부족해서 저희 어머님한테 씹할년이라고 해서 시비가 붙었는데 나중에는 저희 어머님을 벽에다가 사정없이 처박고 금고에서 돈을 훔쳐가다가 저희 어머님한테 붙잡힌 것입니다. 저희 어머님은 절대로 거짓말 하실 분이 아닙니다.

나 : 아주머니 그 때 계시지도 않았으면서 보신 것처럼 말씀하시 마십시오. 본 것만 말씀하세요. 아주머님은 중간에 올라오셨다가 그냥 쳐다만 보고 애기 안고 바로 나가셨쟎아요?

파출소장 : 정선생 그 때 그 자리에 있었어요?

정선생 :.......? 아니요. 그 자리에는 없었는데요, 애기 데리러 갔는데 애기가 겁을 먹고 있었습니다.

나 : 애기가 울지 않았습니다. 돈하고 사진봉투를 금고에다 처박고 저를 째려보시면서 “넥타이 메는 놈이 아침부터 돈 6천원도 없이 사진 찍으러 왔다면서 재수 없다”고 했을 때, 제가 순간을 못 참고 제 입에서 ‘아, 씹할’이란 말이 튀어나온 다음에 주인아주머니가 욕을 하면서 달려들어서 저를 한참 패고 난 다음에 그래도 분이 안 플리신가 밖에 나가서 누구를 부르셨는데, 두 번째로 온 사람이 이 아주머니셨는데 제가 감정 안 부닥치려고 눈을 피했고, 이 분도 잠시 머뭇거리다가 ‘출근해야 한다.’면서 애기 안고 바로 나갔습니다.

파출소장 : 정선생 있을 때 이 사람이 어머니한테 폭력행사 한다거나 욕을 하는 것 봤습니까?

내가 파출소장 눈을 보고 정선생이란 여자 눈을 보고 먼저 말했다.

나 : 나는 그 때 아무 말도 안하고 있었습니다. 젊은 부인하고 눈만 한 번 마주치고 말도 한마디 안했습니다.

정선생 : 아니요. 저 있을 때는 욕도 안하고 폭력도 안 썼습니다.

파출소장 : 그러면 정선생은 이 사람을 또 언제 봤어요?

정선생 : 이 사람이 금고에서 돈 훔쳐가다 저희 어머님한테 붙잡혀 있을 때요. 시끄러워서 밖에 나와 보니 저희 어머님이 이 사람을 붙잡아 놓고 있었습니다.

파출소장 : 그 때 이 사람이 어머님한테 폭력을 행사하거나 욕을 하는 것 봤습니까?

정선생 : 아니요, 주위에 사람들이 몇 십 명 되게 많이 있어서 그런지 폭력도 안 쓰고 욕도 안했습니다.

나 : 제가 말씀드리겠습니다. 자꾸 나보고 금고에서 돈 훔쳐서 나오다가 붙잡혔다고 하는데 돈을 훔친 것도 아니고 붙잡힌 것도 아닙니다. 내가 가방끈 떨어져서 엉겹결에 출입문으로 나왔는데, 몇 발자국 안 가서 노트북가방은 가방끈 없으면 무용지물이라는 생각에 가방끈 돌려받으려고 돌아서서 다시 들어가려고 할 때 아주머니가 뛰어나오면서 “금고에서 돈 훔쳐간 도둑놈 잡아라”고 소리쳤습니다. 그리고 사진관 주인이 막 ‘개새끼 도둑놈 새끼’를 연발하면서 갑자기 저한테 가방끈을 휘둘렀습니다. 내가 10대 정도를 맞았습니다. 이것 보세요. 아주머니가 이 쇠고리 달린 가방끈으로 휘둘르는 것에 맞아서 제 손등에 피멍까지 들었습니다. 사실은, 제가 폭행을 한 것이 아니고 폭행을 댱했다고 할 수 있습니다.

파출소장 : 정선생은 이만 가셔서 일 보세요.

정선생 : 다시 한 번 말씀 드리는데요, 저희 어머님은 절대로 거짓말 하실 분이 아닙니다. 잘 좀 봐주세요. 수고들 하십시오.

파출소장 : 걱정하지 말고 가서 일보세요.

정선생이 나가면서 경찰들한테 정중하게 인사를 하는 것을 내가 경찰들 눈들을 쳐다봤다. 인사하는 사람이 거의 없었다. 사진관 딸 - 유치원선생인 정선생이 나가고 나서부터 파출소장 태도가 달라지기 시작했다.

파출소장 : 당신 직업이 뭐라고 그랬어?

나 : 예, 사업하다가 어려워져서 쉬다가, 2년 정도 저 아래 교통부 일일취업안내소에 다니면서 건설현장에 노가다 다니다가, 최근에 보험사 영업 좀 해보려고 취직해서 교육받고 있는 중입니다. 회사 나간 지 보름 정도 되갑니다.

파출소장 : 당신이 한 행위는 강도에 폭행이야. (소장이 비위 상하는 미소를 흘리면서 자신있게 쏘아붙히면서 말했다.)

나 : 소장님, 그것은 강도도 아니고 폭행도 아닙니다.

파출소장 : 당신이 한 행동은 강도에 폭행이 맞아. 아침부터 폭행에 강도짓까지 해 놓고 엉뚱한 소리하고 있어.(파출소장이 내 신분을 밝히자 무시하는 태도가 역력했고, 이 때부터 일방적으로 사진관 주인 편으로 결정을 내리기 시작했다.)

나 : 소장님, 폭행도 아니고 강도도 아닙니다.

파출소장 :무슨 소리야? 금고에서 돈 훔쳐가려고 처박아버렸다고 하는데, 그리고 당신 입으로도 금고에서 돈 훔쳐왔다고 처음에 이야기 했잖아?

나 : 폭행은 전혀 없었습니다. 절대로 폭행을 하지 않았습니다. 처음에 참지 못하고 ‘아, 씹할’했던 것은 부인하지 않겠습니다. 인격수양이 덜 되었다고 생각하고 나이 드신 분하고 아침부터 시비가 있었다는 자체가 부끄러운 일이라고 인정을 하겠습니다.
그러나 그 이 상 한번도 욕설을 한 적이 없고 폭행을 한 적이 없습니다. 오히려, 아주머니가 저한테 막무가내로 저한테 욕을 퍼부으셨고 저를 때리셨습니다. 사진관 안에서는 욕설과 함께 10대 정도를 때리기에 그냥 맞기만 했습니다. 참기는 했는데 기분은 몹시 나빴고, 밖에 나와서도 가방끈으로 후려치는 것을 동네 사람들 몇 십명 앞에서 수없이 여러 번 맞았습니다. 오히려 아주머니가 폭행했다고 할 수 있습니다.

파출소장 : 젊은 사람이 아주 형편없는 사람이구만. 남의 금고에서 돈을 훔쳐 나오면 그것이 강도지 어떻게 강도가 아니야?

나 : 물론 내가 금고에서 돈을 가지고 나온 것은 맞습니다. 그렇지만 다른 돈은 손도 안 대고 내가 준 돈 4천원만 가지고 나왔습니다. 몰래 가지고 나온 것이 아니고 아줌머니한테 ‘내 돈 가지고 갑니다.’말하고 들고 나왔습니다.

보고 있던 경찰관들이 눈이 동그래지기 시작했다.

파출소장 : 아주머니 이 사람 말이 많습니까? 이 사람이 금고에서 4천원만 들고 나오고 다른 돈은 손 안 댔어요?
사진관주인 : 예, 다른 돈은 손 안 댔어요.
파출소장 : 당시에 금고에 4천원 말고 다른 돈도 같이 있었습니까?
사진관주인 : 예, 다른 돈들도 같이 있었는데 다른 돈들은 손 안 댔습니다.
파출소장 : 당신이 그 돈을 남의 금고에서 가지고 나온 것은 맞기는 맞지요. 지금 그 돈 어디 있습니까?

나 : 예, 그 돈은 내 돈이라고 생각하고 가지고 간다고 말하고 들고 나왔습니다. 그런데, 밖에 나와서 아주머니가 저한테 가방을 휘둘러서 때릴 때 내가 휘두르는 가방끈 고리에 왼손을 맞아서 오른손으로 감싸쥐었는데, 그 때 순간적으로 주인이 달려들어서 제 혁대를 잡고 한 손을 제 오른쪽 바지 주머니에 집어넣어서 빼갔습니다. 처음에는 못 빼가게 하려고 잡았는데, 그러자 제 바지 혁대끈이 떨어지고 바지 주머니가 찢어지려고 하고....... 제가 잡고 있던 아주머니 손을 놔 주자 아주머니가 돈을 뺐어갔습니다. 지금은 그 돈은 아주머니가 가지고 있습니다.

파출소장 : 아주머님, 이 사람 말이 맞습니까?

사진관주인 : 예, 맞습니더. 금고에서 돈 훔쳐가는 도둑놈을 가만 놔두면 되는교? 나를 벽에다 처밀고 돈을 훔쳐가는 것을 벌떡 일어나 쫓아나와서 금고에서 돈 훔쳐간 도둑놈 잡으라고 고함을 치면서 막 팼지예? 가방끈을 휘둘러서 막 팼습니다. 도둑놈을 잡어야 안 되겠는교? 어찌나 분이 나고 썽이 나던지 막 팼습니더. 그라고 달려들어서 바지주머니에서 돈을 뺏어 냈어요. (소장이 편을 들어준 것을 감지한 사진관 주인이 무용담처럼 자랑했다.
이것은 사진관 주인이 스스로 “폭행죄” “명예훼손죄” “강도죄”를 인정하는 것이었다.)

파출소장 : 이 사람이 같이 때리거나 욕설을 하지 않던가요?

사진관주인 : 금고에서 돈 훔쳐간 도둑놈이 때리면 맞아야제 어떻게 할 수 있는교? 사람들이 멧 십 명이나 쳐다보고 있는데, 지가 하며는 어떻게 하겠는교? 막 팼슴니더. 도둑질하다 잽힌 놈이 때리면 때리는 대로 맞아야제, 이 사람은 도둑질하다 잽힌 도둑놈 아인교? 욕도 못했지요. 우리 집 앞에서 욕하면 옆에 사람들이 가만히 있겠어요? 금고에서 돈 훔쳐간 도둑놈 잡으라고 해서 옆집 옆집에서 사람들까지 막 뛰어나와 있었는데?

나 : 제가 밖에서만 맞은 것이 아니고 안에서도 아주머니한테 주먹으로 10대 정도나 쥐어 박혔습니다. 제가 그것을 폭행이라고 강조하는 것이 아니라 형평을 보시라고 말씀을 드리는 것입니다.

파출소장 : 사진관 안에서도 때리셨어요? 이 사람은 같이 욕을 하거나 안 때리던가요?

사진관주인 : ‘씹할년’이라고 하길래 어찌나 분이 나고 썽질이 나던지 막 달게 들어서 주먹으로 팼습니다. 지가 잘못을 했는 것을 아는가 안 뎀비데요. 지 애미같은 사람한테 씹할년이라 했으니 때리면 때리는 대로 맞아야지요. 막 화가 어찌나 나던지 분이 막 풀릴 때까지 주먹으로 팼습니다. 지 놈이 먼저 욕을 했으니 때리면 맞을 수 밖에요? 맞기만 하고 더 이상 욕도 안했습니다.

사진관 주인 입에서 청산유수로 말들이 쏟아졌다. 사진관 주인이 나에 대한 폭행을 스스로 시인을 하였던 것이다. 그리고 ‘내가 벽에다 처박은 것 말고는 더 이상의 폭력이나 폭언이 없었다는 것을 증언해 주었다. 옆에 경찰들이 긴장해서 쳐다보고 있었다. 파출소장도 아주머니의 청산유수에 난처한 표정이었다.

나 : 소장님, 내가 금고에서 내가 준 돈 4천원을 다시 가지고 나온 것은 강도가 아닙니다. 저는 현금이 4천원밖에 없었는데, 증명사진값이 4천원이 넘지 않을 것으로 생각을 하고 사진을 찍으러 갔다가 사진값이 6천원이라고해서 사정을 말씀드렸더니 잔금 2천원은 나중에 갔다드리기로 하고 4천원을 드리고 사진을 받았습니다. 그 때부터 그 사진은 제 소유물이 된 것이고 저는 단지 주인에게 2천원에 대한 채무관계만 남은 것입니다. 그런데 제가 연락처를 적어드리려고 볼펜을 찾다가 무실결에 증명사진값이 생각보다 비싸다는 말 한마디에 주인이 기분이 나쁘다고 돈을 받고 준 사진을 다시 낚아채 가버렸는데 그럴 수는 없습니다.

사진을 뺏어가서 주민등록을 보여주라고 해서 주민등록을 보여줬더니 “아침부터 재수 없게 한다”면서 주민등록증을 맡기라고 했는데 ‘주민등록증을 맡길 수 없다’고 하자 모욕적인 말을 하면서 손님인 제가 보는 앞에서 사진을 처박아버렸습니다. 이후로 제가 사진을 주던지 돈을 주던지 하라고 요구해도 돈도 주지 않고 사진도 주지 않았습니다. 이것은 주인이 거래관계에서 계약을 스스로 어긴 것입니다. 나는 벌써 사진의 주인의 되어 있었고 주인한테 2천원만 갚아줘야할 채무관계만 남았었는데, 한 번 이루어진 거래를 주인이 사진도 안 주고 돈도 안 주고 하는 것은 주인 스스로가 계약을 파기한 것입니다. 그러므로 그 거래 관계에서 있었던 돈 4천원은 다시 원래 주인인 저의 소유가 된 것입니다. 제가 제 돈을 들고 나온 것입니다. 전체 사진값 6천원은 나중에 언제라도 주고서 사진을 찾아가면 비난받을 일이 아닙니다. 잘했다고 따지는 것이 아니라 강도라고 해서 말씀을 드리는 것이고.......

금고에 사진하고 돈하고 같이 있었는데 사진은 그냥 놔두고 내 돈만 내가 들고 나왔으므로 그것은 강도가 아닙니다. 그리고 몰래 들고 나온 것이 아니라 몇 평되지도 않은 실내 맞은편에 주인이 청소하면서 카메라를 이동하고 손질하고 있었는데 주인한테 ‘내돈 내가 가지고 갑니다.’하고 가지고 나왔으니 더더구나 강도가 아닙니다.

옆에 경찰관들이 애매한 문제라 관심을 가지고 집중해서 듣고 있었다. 그 때 옆에 있던 경찰관 (정병근)이 물었다.

경찰관 : 아주머니가 저 사람보고 주민등록증 맡기라고 하셨어요?

사진관주인 : 했지예. 처음부터 돈이 부족하면 부족하다고 사정을 했으면 사진을 줬을 것인데 테이블을 탕탕치면서 사진값이 비싸네 마네 하면서 사진을 주라고 하길래 주민등록증을 보자고 했고, (보여주기에) 주민등록증을 맡겨놨다가 나중에 잔돈 갚아주고 찾아가라고 했지예. 내가 저 사람이 어디 사는 누구인지 알 수가 있는교? 사진 찍어 놓고 사진값 떼먹으면 우리만 손해 아인교? 주민등록증을 맡기라고 해도 못 맡기겠다고 하면서 성질을 부려서 사진하고 돈하고 금고에다 넣어버렸습니다.

(사진관 주인이 상거래에서 외상값을 받기 위하여 주민등록증을 맡기라고 자신만만하게 역설했다.
....... 주민등록법 제 21조-벌칙-에 “주민등록증을 채무이행의 수단으로 제공한 자 또는 제공을 받는 자는 3년 이하의 징역 또는 1천만원 이하의 벌금에 처한다.”고 규정하고 있다.)

파출소장이 아주머니 편을 드는데, 옆에 경찰들이 민망해했다. 따지자면, 사진관 주인이 여러 가지로 잘못한 것이 사진관 주인이 무용담처럼 한 말 속에 들어있었던 것이었다.

나 : 아주머니 말씀 비틀어서 동네에서 젊은 사람 나쁜 사람 만드려고 하지 마세요. 내가 처음부터 사진값이 비싸다고 성질을 부리면서 테이블을 탕탕쳤다고 말씀을 하시는데 아주머니가 거짓말 하시는 것입니다. 아주머니 입으로도 사진값 6천원 중에서 4천원은 받았다고 말씀하셨잖아요? 그러면 아침에 당장 회사 출근해서 사진 제출해야 시험볼 수 있는 사람이 4천원만 주고 사진도 못 받고 테이블을 탕탕칠 수 있습니까? 상식적으로 말이 되는 소리를 하십시오.

저는 테이블을 한번도 친 적이 없고, 제가 볼펜으로 휴대폰번호를 적으려다가 연락처를 적으려고 하는데 적을 필요 없으니, 주민등록증 보여주라고 했다가 주민등록증 맡기라고 해서 못 맡기겠다고 하자, 아주머니가 저한테 갑자기 장사하는 사람 상식으로는 있을 수 없는 모욕적인 언사를 하셨고, 저를 째려보시다가 사진봉투하고 돈하고를 금고에다가 처박고 또 다시 모욕적인 언사를 하시길래 제가 순간을 못 참고 ‘아, 씹할’이라고 한 것밖에는 없습니다. 방금 전에 아주머니 막 욕하고 패도 제가 욕도 안하고 맞고만 있었다고 말씀 하셨잖아요? 상식적으로 통하는 말씀을 하세요.

사진관 주인이 말문이 막혔다. 이 때 조회를 준비하기 위하여 모여 있는 경찰관들이 웅성거리기 시작했다.

사진관주인 : 예 맞아요. 돈을 훔쳐가기에 내가 막 쫓아가서 잡았지요?

나 : 그럼 내가 언제 아주머니를 벽에다 처박았단 말입니까?

사진관 주인 :.......? (주인이 말이 막혔다. 그리고 허둥대다가 다시 말했다.)
돈 훔쳐가기 전에 처박았잖아요? 젊은 사람이 잘못을 했으면 미안하다고 하세요.
(사진관 주인이 더듬거렸다.)

나 : 그럼, 그 때 나는 금고 옆에 있었고 아줌마는 5-6미터 떨어진 카메라 쪽에 있었는데, 내가 돈 4천원 훔쳐갈라고 일부러 아줌마한테 쫓아가서 아줌마를 벽에다가 처박고 금고까지 다시 와서 돈을 빼갔다는 말씀입니까? 아주머님이 다 맞다고 했잖아요? 옆에 계신분들도 상식적으로 한번 생각해 보세요.

사진관 주인의 거짓말이 입증이 된 셈이다.
경찰관들이 웅성거리기 시작했다. 그런데 궁지에 몰린 사진관 주인이 말을 바꾸면서 어거지를 썼다.

사진관주인 : 내가 돈 훔쳐가려고 하는 것을 잡으려고 막 쫓아오니까 나를 사정없이 밀어서 처박았잖아요? (주인이 거짓말을 하는 것이었다. 처음에는 처박아 놓고 돈을 훔쳐갔다고 했다가, 이제는 쫓아오니 처박고 돈을 훔쳐갔다는 것이었다. 경찰들 20여명이 다 보고 있었다.)

나 : 거짓말하지 마세요. 나는 벌써 마음속으로 준비 다 되어 있었는데 손한번 뻗어서 돈 끄집어 내는 것이 빠르겠어요? 아니면, 아주머니처럼 동작 느린 사람이 갑자기 쫓아오는 것이 빠르겠어요?

사진관주인 : (말을 못하다가) ....... 아저씨가 나를 밀긴 밀었잖아요?

사진관 주인의 변명이 궁색해졌다. 경찰들이 사진관 주인의 얼굴을 쳐다봤다.

나 : 말씀 비틀어서 하지 마세요. 내가 돈 집어넣고 왼손에 가방 들고 오른손에 우산 들고 출입문 쪽으로 나오다가 잡혔잖아요? 아줌마가 나를 막 잡으려다가 내 가방어깨끈을 잡으셧잖아요? 그리고 나서 아줌마가 두 손으로 가방끈을 잡고 돈 내놓고 가라면서 내 가방을 빼으려고했고 나는 계속해서 가방을 놓으라고 했고, 그렇게 실냉이를 하다가 가방끈이 떨어지면서 아주머니는 주춤거리다가 엉덩방아를 찧으면서 넘어졌고, 나는 출입문으로 바로 나갔잖아요? 내가 아주머니 넘어질 때 봤는데 아주머니 주춤거리다가 엉덩방아만 찧었지 머리 안 다쳤습니다.

듣고 있던 경찰관들이 이제 상황 판단이 되가는 모습이었다.

나 : (출동 나온 경찰관 신상윤을 가리키며) 아저씨, 아저씨들 나오실 때 그 때도 저 분이 가방끈을 들고 계시면서 저를 때릴려고 하길래 ‘못 때리게 하시라’하고 ‘저 가방끈 제 가방에서 떨어진 것이니 저한테 넘겨주라’고 하라고 했지요. 그래서 아저씨가 넘겨주라고 해서 아줌마가 저한테 넘겨줬지요? 아저씨가 말씀 좀 해주세요.

파출소장 : (출동나온 경찰을 보면서) 맞어?
경찰관 신상윤 : 예, 아주머니가 가방끈을 가지고 있었습니다. 제가 넘겨주라고 해서 넘겨줬습니다.

파출소장 : 그 때 그 가방끈이 저 사람 가방에서 떨어진 것이 맞습니까?

사진관 주인 : 예

이상과 같은 쌍방 진술로서, 엄밀히 따지지 않고 법에 관한 전문가가 아니라도 사진관 주인의 잘못이 아주 많다는 것을 사진관 주인 입을 통해서 스스로 증명이 되었다.

내가 긴장한 가운데서도 상황 진술을 몇 평 되지도 않은 파출소 안에서 경찰관들 20여명 앞에서 제대로 받아낸 것이었다. 물론 파출소 안에 CC-TV 두 개가 정상적으로 돌아가고 있었다. 나는 상황파악의 전문가이고 정보수집이나 분석에 있어서 상당한 전문가이다. 옆에 있는 경찰들이 처음에 선입견을 가지고 있다가 잘 풀어졌으면 하는 분위기였다.

그런데 파출소장은 ....... 여전히 편파적으로 나를 엮으려고 했다. 사진관 주인의 죄가 사진관 주인의 말 속에 벌써 여러 가지가 드러났는데도 그것을 덮어두고 나한테만 뒤집어씌우려고 했다. 뻔뻔하고 파렴치한 사람이었다. 그 많은 부하 직원들이 보고 있는 곳에서 경찰이란 직업을 모욕하고 있었다.

파출소장 : 어쨌든 당신은 남의 금고에서 돈을 훔쳐 나왔으니 강도가 맞고 폭행범입니다.
아주머님은 머리 좀 괜찮으세요? 딴 데는 어디 아픈데 없고요? 못된 놈 만나서 아침부터 고생이 심하시네요.

그 때부터 상황이 불리해진다고 느낀 사진관 주인이 파출소장이 일방적으로 자기를 비호하자 엄살이 심해지기 시작했다. 용감무쌍하게 말하던 목소리는 이내 수그러들었고 죽는 소리를 했다. 옆에 있는 경찰관 몇 명이 머리 다친 부분을 보자고 했다.

내가 먼저 선수를 쳐서 말했다.

나 : 아줌마 다치지 않았습니다. 내가 넘어질 때 봤는데 주춤거리다가 엉덩방아만 찧었지 머리는 다치지 않았습니다. 머리에 보면 표시가 나지 않을 것입니다. 머리는 안 다쳤으니까요.

경찰관 : 다친 데가 어딥니까?
사진관 주인 : 여기요
경찰관 : 아무런 표시가 안 나는데요? 머리를 쿵하고 부딪혔으면 표시가 날 것인데.......?
사진관 주인 : 여기도 아파요.
경찰관 : 거기도 아무렇지도 않는데요?

사진관 주인이 처음에는 머리 뒷부분이 아프다고 했다가 표시가 없다고 하자 이번에는 머리 옆이 아프다고 했다. 머리를 살펴보던 경찰관이 소장을 보고 고개를 흔들었다. 다른 경찰관 2명인가가 “어디보자”면서 더 살폈다. 역시 아무런 표시가 안 난다고 했다.

파출소에 있는 경찰들이 전체적으로 아주머니가 거짓말한다는 것을 눈치 채기 시작했다. 솔직히, 대한민국 경찰이 최소한의 양심이 있다면 사진관 아주머니의 행위가 주민등록법 위반, 폭행, 강도, 명예훼손에 해당된다는 것을 모를 리 없는데 사진관 주인이 무용담처럼 이야기를 되풀이해서 이것들을 확인시켜줬고, 파출소장이 빤한 것을 가지고 나만 추궁하는 것이 이치에 맞지 않다고 느꼈을 것이기 때문이다. 파출소장이 주민등록법, 폭행죄, 강도죄,명예훼손죄의 개념을 모른다면 그것은 지나가는 개가 웃을 일이다.

출근시간이 다가오고 있었다. 내가 두 손을 합장하고 정중하게 파출소장한테 말했다.

나 : 소장님, 아주머니 말씀 중에 저에 대한 폭행부분도 나오고 주민등록증 주라고 하는 부분도 분명히 있습니다. 제 손 좀 보세요. 퍼렇게 피멍이 들어서 이렇게 부어 있지 않습니까? 이것은 분명한 폭행입니다. 그리고 동네 사람들 앞에서 저를 후려치면서 금고에서 돈 훔쳐간 도둑놈이라고 고함을 친 것은 따지자면 명예훼손입니다.
제가 이것들을 굳이 따지려고 하는 것은 아니지만, 소장님이 저한테 강도죄하고 폭행죄를 말씀하시는데 제 입장에서도 생각을 해보십시오. 사법적인 판가름을 하시는 입장에서 선입견을 버리고 공정하게 살펴주시기 바랍니다. 저는 사건이 확대되는 것을 원하지 않습니다.
저는 사업 어려워져서 몇 년 동안 노가다 다니다가 15일전쯤에 어렵게 회사에 취직해서 교육받고 있는데 빨리 출근해서 회사에 사진 제출해야 이번 달에 시험 볼 수 있습니다. 이번에 시험 못 보면 또 한달 반을 놀아야합니다.

그 때 경찰관 한 명이 ‘아침- 조회시간’ 다 되어 간다고 보고를 했다.

파출소장 : 아주머니하고 이 사람 2층으로 데리고 올라가. 신상윤 경장이 같이 올라가서 이 사람 도망 못 가게 잘 감시해요.

그러자 경찰관 몇 사람이 나섰다.

경찰관 신상윤 : 애까지 둘이나 있다고 하고 몇 년 만에 이제 막 취직했다고 하는데- 아줌마가 다친 것도 안 보이는데, 출근시키고 조사할 것이 있으면 나중에 다시 나오라고 하지요? 요새 취직하기도 힘드는데.......

경찰관 김철중 : 그냥 보내지요? 별 것도 아닌 것 같은데.......

찬물을 끼얹은 듯 조용해져 버렸다. 부하들을 휘어잡는 카리스마가 상당했다. 파출소장은 키가 177센티 정도 되는 사람으로, 인상은 - 얼굴이 넓적하면서 얼굴색이 거무잡잡하고, 턱의 윤곽이 선명하게 발달되었고, 광대뼈가 발달되었고, 코가 오똑하고, 눈은 가늘면서 찢어졌고, 입술은 가늘고 검은색이 돈다.

경찰 조직의 위계질서가 그렇게 셀 줄은 몰랐다. 내가 다른 경찰들 눈들을 봤다. 다들 눈들을 피했다. 경찰관 신상윤이 미안한 표정으로 2층으로 올라가자고 했다. 이 때가 8시 50-55분 경이었다.

2층에 올라갔더니 파출소 2층은 너무너무 조잡했다. 의경들 잠자는 방이 하나 있고, 방 앞에 작은 원탁- 식탁이 있었고, 작은 씽크대에 가스렌지가 놓여 있었다. 벽지며 장판은 10년도 넘어보이게 색이 바라고 낡았고, 식탁도 오래 되고 낡아서 기스가 심하게 나 있으면서 때 자국으로 더러웠고, 씽크대며 가스렌지를 보니 구역질이 날 지경이었다. 늙은 아주머니 한 분이 설것이를 하고 계셨는데 밥 때 되면 와서 의경들 밥을 차려준다고 했다.

파출소 2층에서 회사에 출근해야한다는 강박관념과 사진을 갖다 줘야 한다는 초조감에 긴장이 되어서 담배를 연거푸 피웠다. 시간이 지날수록 초조감이 심해졌고 .......시간이 9시 5분이었다. 회사에 전화를 걸어 ‘내 사진 기다리지 말고 다른 사람들 원서를 먼저 금융감독원에 접수시키시라’고 했다. 파출소에 잡혀 있다는 말을 못하고 끊었다. 이후로 전화가 여러번 왔다. "빨리 사진 가져오라고."

9시 25분쯤 되니 아침조회가 끝났으니 다시 내려오라고 했다.

파출소장 : 반성해보니 ‘강도죄’하고 ‘폭행죄’가 맞지요?

나 : 폭행도 아니고 강도도 아닙니다. 다만 제가 아침부터 나이 드신 분하고 시비가 있었던 것은 인간적으로 성숙하지 못했다는 것을 인정하고 사과를 드립니다. 그렇지만 사법처리 받을 정도는 아닙니다.

잠시 후에 60이 넘어 보이는 풍채가 좋으신 할머니 한 분이 들어오셨다. 파출소장이 정중하게 맞았다. 기억을 더듬어보니 그 할머니는 파출소 바로 옆 건물의 유치원 원장이었다.

우리 동네는 파출소와 동사무소가 붙어 있는데 동사무소 반 지하에 유치원이 있다. 이제야 사진관 딸이 누구인지 알 수 있었다. 파출소 옆 유치원의 선생이었던 것이다. 그래서 모든 경찰관들하고 알고 지내는 사이였던 것이었다.

유치원 원장 : 출근하니까 우리 정선생이 자기 어머니가 아침부터 젊은 사람한테 심하게 폭행을 당했다고 저보고 파출소에 올라가서 말 좀 잘해주라고 해서 올라왔습니다. 폭행한 못된 사람이 누굽니까?
