[News] Gangnam Plastic Surgery Surgeons Lose One after another 'Side Effects of Plastic Surgery'

Patients who suffered from the aftereffects of plastic surgery filed a lawsuit against a plastic surgery hospital in Gangnam, Seoul, and won one after another. The court decided that even if there was no problem with the surgery, if the hospital did not specifically explain the side effects of plastic surgery to the patient, it should be liable for compensation.

In February 2009, A (30, female) underwent breast enlargement surgery and fat inhalation surgery at a plastic surgery clinic in Cheongdam-dong, Seoul. After two surgeries, A's left and right chest positions were changed, and scars remained on the fat inhalation site. A filed a lawsuit against the director, saying, "The operation went wrong and there were side effects," but the first trial court ruled against the plaintiff, saying, "There is insufficient data to believe that the operation was wrong." However, the Seoul Central District Court's Civil Appeals Department 5 (Chief Judge Kim Seung-pyo) said on the 25th that the hospital did not fully explain the side effects, and that it ruled in favor of the plaintiff, saying, "The director should pay A 10 million won."

At the time of the surgery, A signed a consent form stating that he had been fully explained about the precautions and side effects. However, the court explained, "It cannot be said that the explanation was completed just by receiving the consent form," adding, "The hospital violated A's right to decide whether to operate or not." Judge Kim Yoon-sun of the same court also ruled in January that B (44, female) should compensate about 15 million won in a lawsuit filed against the plastic surgery director in Sinsa-dong, Seoul, saying, "The double eyelid surgery caused side effects." B also signed a consent form for surgery saying, "I heard an explanation of inflammation and bleeding," but Judge Kim thought the hospital's explanation was insufficient.

The court decided that if the surgery was carried out several times, the hospital should explain each side effect in detail. C (36, female) underwent five breast enlargement surgery at a plastic surgery clinic in Sinsa-dong, Seoul in 2006. After undergoing several surgeries, he suffered side effects such as necrosis of the skin in the chest area. The hospital director explained infections and skin necrosis during the first and second surgeries. However, consent was not received from the third operation, and skin necrosis was not explained from the fourth operation. Judge Kim ruled in February that "the hospital did not specifically explain the side effects of each operation," and that "pay C 57 million won."
